This article discusses the increasing trend of the court system to rely upon Special Master to help deal with disputes related to the discovery phase of litigation, especially those concerning eDiscovery matters.
The article states, "With as many as 123,000 pending civil suits in the DOJ caseload, it is becoming increasingly common for overloaded attorneys and judges to rely on the oversight provided by qualified special masters. These special masters are charged with acting as liaisons and moderators to quickly resolve discovery disputes over ESI, and to provide guidance that judges usually follow closely in making their decisions."
P.S. Special Master's serve a vital role in complex litigation where vast amounts of electronically stored information are involved as evidence. The use of Special Masters is certainly likely to continue with increasing regularity.
