REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

A proposed regulation posted on the statewatch.org website by the European Commission.

This proposed regulation addresses the protection of personal data.  This proposal seeks to regulate the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation).  This proposal hopes to provide uniform regulations across the EU Member nations.

The proposal states, "a proposal for a Regulation of the European Parliament and of the Council on the
protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), and

– a proposal for a Directive of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by competent authorities for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, and the free movement of such data (Police and Criminal Justice Data Protection Directive)."


The proposal further states, "A Regulation is considered to be the most appropriate legal instrument to define the framework for the protection of personal data in the Union. The direct applicability of a Regulation will reduce legal fragmentation and provide greater legal certainty by introducing a harmonised set of core rules, improving the protection of fundamental rights of individuals and contributing to the functioning of the Internal Market."
